The Company
In these conditions of sale “NESS GLAZING” is referred to as “The Company·

Ownership
The Customer warrants that he is proprietor, in whole or In part, of the subjects where the Installation Is to take place and that, In so far as he may not be the proprietor of the subjects, he enters Into the Contract as Agent tor any other proprietor or proprietors. For the avoidance of doubt, liability among proprietors, If more than one, Is Joint and several.

Terms In Writing
The Customer should ensure that any representation or promise made before or at the time of signature to the Contract not Included In the printed form of the Contract Is added In writing on the face of the Contract and signed by the Customer and the Company or its Agent. In this way there will be no doubt as to the terms of the representation or promise.

Survey
The Company reserves the right to decline this Contract subject to the technical surveyors report. The customer must make arrangements to allow survey to be done In daylight hours.

Conservation and Planning
If the property Is in a conservation area and/or where planning permission or building warrant Is required, then it is the sole responsibility of the Customer to obtain such approval.

Material Specification
The Company reserves the right to alter the specifications of any of its products without prior notice to the Customer. The Company shall at any time, including between the date of order and the dote of delivery be entitled to make any changes to the specification of the goods or any reason deemed necessary by The Company, providing such change doesn’t materially effect the goods or their performance.

Window and Glass Specification
(a) Window Specification
Compliance with British· Standard Code of Practice CP 153 (Part 1 1969) shall be the sole responsibility of the Customer. In the event of the specification of windows selected by the Customer not complying with the said Code of Practice the Company will not be liable under any circumstances for any 1085 suffered by the Customer as a result.

(b) Glass Specification
Glass used by the Company in Its products shall be of a thickness and weight determined by The Company’s technical surveyors, but Will comply’ with as 6262 (Safety Glazing). Minor imperfections and scratches are not covered by this guarantee.

Delivery
Time for delivery Is not of the essence of the Contract, and the delivery period quoted is that anticipated at the time off order. The Company will make every effort to maintain or Improve !t.

Damage
The Company shall be under no liability to make good any existing damage or latent defects to brickwork, plasterwork, pebble-dashing, rendering or any similar material. The Company win however make every endeavour to reinstate damage to rough casting plasterwork and Internal woodwork, but excluding “flies and wallpaper• caused solely by the Installation of windows and doors. Such re-lnsta1ement work will be left In a condition ready for decoration. ‘Mien brickwork has· to be knocked down, the Company cannot be held liable for consequential damage.

Blinds
The Company does not accept responsibility for the removal or replacement of blinds, curtains, pelmets etc., or for the cost of altering same if they cannot be refitted due to the new windows or its surround.

Complaint
While the Company reserves the right to insist on payment of the full purchase price at the due time, in the event of any genuine complaint with regard to the Installation, the Company will inspect the installation and any defects found which are the Company’s responsibility will be rectified at no cost to the Customer.

Condensation
The Company gives no guarantee whatsoever with regard to these new products reducing the amount of condensation, as the formation of condensation Is completely out with the Company’s control.

Overdue Accounts
The Company will charge 2.5% per month on overdue accounts, and if the full amount is not paid on the due date the Guarantee will be void, and all goods shall remain the property of the Company until paid in full by the Customer.

Guarantee
The Company guarantees for a period of ten years that where an agreed defect develops In the installation, due to faulty manufacture or instillation, then the Company shall, without cost to the Customer, rectify such agreed defect A copy of the guarantee will be forwarded on receipt of the final payment, If paid on the due date.

Cancellation
Cancellation must be received In writing to the Company no later man seven d􀅓 from date of signing the contract. After which this Contract Is legally binding to the Customer, and not subject to alteration or cancellation by the Customer (deposits are non-returnable).

Access for Installation
The customer will provide reasonable access to enable installation to be completed as soon as advised that the units are ready. If access Is not given wlthin 28 days of the Company’s notification, as a result of the delay on the part of the Customer, then the􀅼balance of the purchase price is immediately due and payable.

Supplies
Quotations and delivery estimates are given and orders accepted in good faith based on materials and labour being normally available. In the event of supplies or labour being adversely affected by strikes, lock-outs or any other disruptions or contingencies beyond the Company’s control, the Company shall not be held responsible for delays, breaches of Contract or any other loss or liability incurred by the Customer through delayed or non-delivery.

Glass
(a) Double Glazed Sealed Units, carry a 5 Year Manufacturer’s Guarantee from the date of Installation. Any Re-fits during this period would be chargeable.

(b) The primary colours of the designs on the glass depicted In the Company brochures will remain as standard. However, where the Customer so requests, a change may be made in the primary colours. The Company shall in such a case be entitled to adjust the price of the said designs by three times the usual price.

Ironmongery
Whilst the Company takes all reasonable steps to preserve the appearance of all brassware and lead ware In Its products, by their nature both brass and lead will tarnish when exposed to the atmosphere. The Company’s guarantee does not therefore extend to cover either brass or lead ware. The Company strongly recommends that the Customer regularly maintains such fittings by cleaning and polishing to reduce, as far as possible, the effects of tarnishing.

Wood Items
The full Conditions of the above 10-year Guarantee applies only to our Composite and PVC window range. Any timber installations I.e. doors, windows etc. will only carry a 3-year guarantee.

Payment
Orders must be made payable to Ness Glazing via BACS or cash.
